Terms of Service

These Terms of Service ("Terms") govern your use of the Bloomland app (iOS and Android) and related services available at bloomland.app (collectively, the "Service"), operated by Akshana Enterprises LLC ("Akshana Enterprises LLC," "we," "our," or "us"), a Delaware limited liability company doing business as Bloomland.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

Bloomland is a tap-driven, gamified language-learning app for children ages 6–12. The Service provides structured 30-day learning paths in Hindi, Mandarin, Tamil, Telugu, and Kannada, delivered through micro-lessons that combine listening, speaking exercises, and (for Hindi and Mandarin) character and script reading. Lessons are delivered as audio-narrated, game-style exercises guided by Babbu, our tiger mascot.

Content is organized into four levels (Basic, Intermediate, Advanced, Master) for each Speak track, and separate Read tracks for Hindi and Mandarin. Content availability by language and level is shown within the app.

2. Eligibility and Account Responsibilities

Who may create an account: You must be at least 18 years old — and the parent or legal guardian of any child who uses the Service — to create a Bloomland account. By creating an account you represent and warrant that you meet these requirements.

Child users: Children ages 6–12 use the Service under your direct supervision and control. Children do not create their own accounts. You are responsible for ensuring that your child's use of the Service is appropriate and consistent with these Terms.

Account security: You are responsible for maintaining the security of your account credentials. Do not share your login information with anyone other than your minor child's supervised use of the device. Notify us immediately at [email protected] if you believe your account has been compromised.

Accuracy: You are responsible for the accuracy of the information you provide, including your child's name and birth year used for in-app personalization and content gating.

One account per family: A single Bloomland account supports up to four child profiles. See Section 3 for subscription details.

3. Subscriptions, Pricing, and Payments

3.1 Free Preview

Bloomland offers a free preview of 3 lessons for every available language, culminating in a Starter Badge. No payment is required to access the free preview. Free-preview users may create one child profile.

3.2 Bloomland Subscription

Bloomland is a single-tier annual subscription covering all languages, all lesson levels, and up to four child profiles on one account.

• Founding rate: $49.00/year (US), available to the first ~50 founding families. The founding rate is rate-locked for life — as long as your subscription remains continuously active, you will not be moved to the regular rate.
• Regular rate (post-founding cohort): announced by Akshana Enterprises LLC before it takes effect. It will fall between $79.00/year and $99.00/year (US).

Local pricing outside the US is set at Stripe's regional equivalent and shown in your local currency at checkout.

3.3 Billing via Stripe (web checkout)

All Bloomland subscriptions are purchased and managed through Stripe at bloomland.app.

• Your payment method is charged at confirmation of purchase.
• Subscriptions auto-renew annually unless you cancel before the renewal date.
• To cancel or manage your subscription: sign in at bloomland.app → open the Parent Zone (a math-gate protects it) → Settings → Subscription → follow the Stripe-hosted billing portal. Alternatively, email [email protected] and we will process the cancellation for you within one business day.
• Akshana Enterprises LLC does not process, store, or have access to your credit card number. Stripe handles all payment card data under its own PCI-compliant infrastructure.

3.4 Mobile App Access to Your Subscription

Your subscription entitlement is tied to your Bloomland account, not to any specific device or platform. Once you have subscribed at bloomland.app, sign in to the Bloomland iOS app with the same credentials and your paid content unlocks automatically. In-app purchases via Apple's App Store are not used at launch.

3.5 Refunds

Bloomland offers a 14-day money-back guarantee on the initial subscription purchase. To request a refund, email [email protected] within 14 days of your first charge and we will issue a full refund via Stripe. Refunds for renewal charges after the first year are considered on a case-by-case basis; contact [email protected].

3.6 Price Changes

We may adjust the regular subscription rate over time. Founding-family subscribers remain at their locked-in rate for as long as their subscription is continuously active. For all other subscribers, we will provide at least 30 days' notice via email before any price increase takes effect at the next renewal.

4. Content License

Subject to your compliance with these Terms and payment of any applicable subscription fees, Akshana Enterprises LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its content (lessons, audio narration, illustrations, characters, and curriculum materials, collectively "Content") for your personal, non-commercial, educational use with your child.

You may not:

• Copy, reproduce, redistribute, or publicly perform any Content
• Use Content for AI model training, dataset creation, or machine-learning purposes
• Reverse-engineer any part of the Service or attempt to extract audio files, curriculum JSON, or other Content programmatically
• Resell, sublicense, or transfer access to the Service to any third party
• Scrape or bulk-download Content by automated means

All Content is owned by or licensed to Akshana Enterprises LLC and is protected by copyright and other intellectual property laws. The Bloomland name, Babbu Tiger character, and associated marks are the intellectual property of Akshana Enterprises LLC.

5. User-Generated Content — Child's Recorded Name

The Service includes an optional feature that lets your child record their own name for playback in celebratory moments. This recording is stored exclusively on your device and is never transmitted to our servers. By using this feature, you grant Akshana Enterprises LLC a limited license to play back the recording within the app for the sole purpose of in-app personalization. This license does not extend to:

• Marketing or advertising use
• Training any AI or machine-learning model
• Sharing with any third party

You may delete the recording at any time from the app's Profile settings.

6. SpeakIt Scoring — Voice Recording

The SpeakIt speaking-exercise feature records your child's voice during pronunciation exercises, sends the audio bytes to our scoring service for Whisper-model transcription, returns a score, and then discards the audio. No audio is retained server-side. The scoring function is for educational purposes only — a score in a Bloomland exercise is not a professional assessment of language proficiency.

7. AI-Generated Content Disclaimer

Bloomland's lesson narration audio is generated using Google Cloud Text-to-Speech. Bloomland's pronunciation scoring is powered by Cloudflare Workers AI (Whisper). Both technologies are highly capable but may occasionally produce errors — a mispronounced audio clip, a miscalibrated score, or a phrase that sounds slightly unnatural. *(Sarah Martinez, §4, ToS outline: "AI-generated content disclaimer.")*

We review content for quality before it is included in the app, but we do not guarantee that every automated output is error-free. If you notice a quality issue, report it to [email protected] and we will investigate.

8. Educational Disclaimer

Bloomland is supplemental enrichment, not accredited language education. *(Sarah Martinez, §4, ToS outline: "Educational disclaimer — 'Bloomland is supplemental enrichment; not a substitute for accredited language education'.")*

Bloomland is designed to help children build vocabulary, pronunciation, and reading-recognition skills in heritage and world languages. We do not represent that completing a Bloomland course is equivalent to accredited language instruction, satisfies any school curriculum standard, or guarantees fluency. Results vary based on the child's prior exposure, practice frequency, and individual learning pace.

Bloomland is intended as a fun, daily supplement to — not a replacement for — other language-learning resources, including family conversation, heritage-language schools, and formal instruction.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to access another user's account or data
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools, bots, or scripts to access or scrape the Service
• Interfere with or disrupt the Service's infrastructure, servers, or networks
• Upload, transmit, or distribute any malicious code or content
• Use the Service in any way not expressly permitted by these Terms

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AKSHANA ENTERPRISES LLC'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO AKSHANA ENTERPRISES LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00). *(Sarah Martinez, §4, ToS outline: "Liability cap — greater of 12 months fees or $100.")*

IN NO EVENT WILL AKSHANA ENTERPRISES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Akshana Enterprises LLC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your breach of these Terms; (c) any content you submit through the Service; or (d) your violation of any third-party right or applicable law.

13. Termination

By you: You may cancel your subscription at any time through the Parent Zone → Settings → Subscription screen inside the app (behind the parent math-gate), through the Stripe-hosted billing portal at bloomland.app, or by emailing [email protected]. Cancellation takes effect at the end of your current billing period; you retain access until then. To delete your account entirely, see Section 14.

By us: We may suspend or terminate your access to the Service if you violate these Terms, engage in conduct we deem harmful to other users or the Service, or for any other reason with reasonable notice. Upon termination for cause, no refund will be issued outside of the 14-day money-back guarantee in Section 3.5.

Upon termination for any reason, your license to use the Content ends immediately.

14. Account Deletion

To request permanent deletion of your account and all associated data:

1. Open the Bloomland app → Settings → Account → Delete Account, or
2. Email [email protected] with the subject "Delete my account."

Deletion terms are as described in our Privacy Policy (Section 9). Subscription cancellation is separate from account deletion; cancel via the Parent Zone or Stripe billing portal (see Section 13) first, then request deletion if desired.

15. Binding Arbitration and Class-Action Waiver

Informal resolution first: Before filing any legal claim, contact us at [email protected] and describe your dispute. We will attempt to resolve it within 30 days.

Binding arbitration: If informal resolution fails, any dispute arising out of or related to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English. The arbitrator's decision is final and binding.

Class-action waiver: YOU AND AKSHANA ENTERPRISES LLC EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this waiver is found unenforceable, the arbitration clause will not apply to the class claim.

Opt-out: You may opt out of this arbitration clause within 30 days of first accepting these Terms by emailing [email protected] with the subject "Arbitration Opt-Out." Opting out does not affect any other provision of these Terms.

Exceptions: Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the arbitration clause in Section 15. *(Sarah Martinez, §4, ToS outline: governing law listed as Massachusetts — Akshana Enterprises LLC's home state per her review context, consistent with the arbitration clause.)*

Any court proceedings not subject to arbitration will be brought exclusively in the state or federal courts located in Massachusetts.

17. Changes to These Terms

We may update these Terms from time to time. For material changes, we will:

1. Post the updated Terms at bloomland.app/terms with a new "Last Updated" date.
2. Send an email notification to the parent's email address on file at least 30 days before the change takes effect.
3. Display an in-app notice upon your next login.

Your continued use of the Service after the effective date of a material change constitutes acceptance of the updated Terms. If you do not agree to an update, you must stop using the Service and cancel your subscription before the effective date.
